The Etoiles Frissons Partner Program is a marketing venture aimed at leveraging private influencers to drive increased web traffic to Etoiles Frissons’ official site and enhance direct consumer sales. This program is by invitation only, offered to select individuals and entities approved by Etoiles Frissons under specific terms.
Upon applying for affiliation online, you will acknowledge and agree to these terms by selecting the appropriate confirmation box, affirming your understanding and legal adherence to the agreement’s stipulations. Additionally, you will be asked to review and accept the Etoiles Frissons Privacy Policy, which governs your participation in the program.
Terms Overview
This contract represents a comprehensive agreement between you and Etoiles Frissons, detailing the conditions of participation in the Etoiles Frissons Partner Program.
“Affiliate” pertains to private entities sanctioned by Etoiles Frissons to join the program under these terms, using their digital platforms to promote Etoiles Frissons.
“Commission Fees” denote earnings paid by Etoiles Frissons for qualifying purchases made by referred customers through your promotional efforts.
“Affiliate Site” or “Site” refers to website(s), social media profile(s) and/or any account operated by the affiliate and on which the affiliate will insert HTML links redirecting to the Website.
“Qualified Purchase” signifies an authorized sale of Etoiles Frissons products made on the Website (i.e. the official Etoiles Frissons website www.EtoilesFrissons.com) to a referred customer, adhering to the program’s criteria.
“Referred Customer” is a buyer who has been directed to Etoiles Frissons through your promotional activities.
This program is intended for United States of America affiliate network, with commissions primarily generated from specified regions.
Enrollment and Compliance
To start, submit the online application via the official Etoiles Frissons website. We may decline or cancel your application based on unsuitability criteria, including but not limited to content promoting illegal activities, discrimination, or infringement of intellectual property rights.
Affiliate Responsibilities
Participation in the Etoiles Frissons Partner Program signifies your agreement to the following conditions:
- You affirm that you are at least 18 years old and legally capable of entering a binding contract.
- You confirm ownership or possess the necessary licenses for all content displayed on your website or included in your newsletter.
- You guarantee that your website and/or newsletter fully complies with all applicable laws and regulations, avoiding any form of illegal content.
- You ensure that your website and/or newsletter is free from any false information or content that could be considered defamatory, or that infringes on privacy, publicity rights, or any form of intellectual property rights including copyright, trademarks, patents, or other proprietary rights.
- You agree to appropriately place our banners or links on your website, or within non-spam email communications, adhering to ethical email marketing practices.
- Usage of our banners or links in any unauthorized contexts, such as newsgroups, chat rooms, message boards, banner networks, counters, or guestbooks, etc., is strictly prohibited.
- Non-compliance with these guidelines may result in termination from the Etoiles Frissons Partner Program.
- Engaging in fraudulent activities to generate sales or click-throughs, whether through the use of automation, scripts, or manual refreshing of pages with the sole intention of generating commissions, is a serious violation and will be treated as such.
As a participant in the Etoiles Frissons Partner Program, you will gain access to our Affiliate Account Manager dashboard. This platform allows you to:
- Review detailed information about the program and access our latest affiliate newsletters.
- Download HTML codes for embedding links to our website on your platform, alongside creative banners designed for promotion.
- Obtain unique tracking codes for our products, enabling the accurate monitoring of referrals and commissions.
All provided materials, including HTML links to our website, must be used in accordance with the specific guidelines and instructions provided by Etoiles Frissons, ensuring alignment with our brand’s standards and promotional objectives.
Etoiles Frissons’ Rights and Obligations
We reserve the right to monitor your compliance with this agreement and may advise or require changes to your promotional practices to maintain alignment with our brand standards. If you do not make the changes to your Site that we feel are necessary, we reserve the right to terminate your participation in the Etoiles Frissons Affiliate Program.
Termination and Modification
Etoiles Frissons maintains the authority to conclude this Agreement and cease your involvement in the Etoiles Frissons Partner Program instantly and without prior notification if you engage in fraudulent activities within the program or misuse the program in any manner. In instances where fraud or misuse is identified, Etoiles Frissons will not be obligated to provide you with commissions for any sales deemed fraudulent.
Etoiles Frissons reserves the right, at its discretion and under specific conditions, to communicate changes to you via email. These changes may encompass, but are not limited to, adjustments in the range of available commissions, commission rates, payment methods, payment timelines, and the regulations governing the Partner Program. Should you find any of these modifications unacceptable, your sole option would be to end this Agreement and discontinue your participation in the Partner Program. By continuing your involvement in the Partner Program after we announce changes on our website or communicate them to you via email, you are agreeing to and accepting these changes as binding.
Commission Payment
You will receive a Commission for sending Referred Customers to our Website via your links.
Commission fees are set to be processed within a timeframe of approximately 15 to 30 days following the conclusion of the month during which they were earned. The commissions due to you from Etoiles Frissons will reflect a rate of 6% of net sales generated through your referral links during the specified period. Etoiles Frissons is not liable for any fees imposed by third-party services such as PayPal, banks, or other financial institutions in relation to receiving Affiliate Commission Fees.
If a customer returns a product or cancels an order for which a commission has already been paid out, the amount of the commission corresponding to the refunded transaction will be deducted from the partner’s future payments. Etoiles Frissons is committed to transparency and will provide detailed information regarding any such adjustments.
Similarly, if a chargeback is initiated by a customer for a transaction that resulted in a paid commission, the value of that commission will be deducted from subsequent commission payments owed to the partner. Partners will be notified of any chargebacks affecting their commission balance.
In order to receive payment, you are required to submit all essential financial and tax details, including your Employer Identification Number (EIN) and, if applicable, your company registration numbers. You acknowledge and agree that you have the right to access copies of all invoices issued by Etoiles Frissons related to the Partner Program. Furthermore, you acknowledge and accept full responsibility for:
- Meeting your obligations in relation to the EIN, where applicable;
- Paying any taxes on the commissions received from us, as required by law;
- Promptly reviewing all invoices and requesting copies of any documents not received from Etoiles Frissons;
- Informing Etoiles Frissons of any updates to your company’s tax identification information;
- Adhering to all relevant tax laws, regulations, and rules.
Tax Obligations: You agree that you are solely responsible for any tax obligations that may arise with all relevant tax authorities as a result of commissions earned through your participation in the Etoiles Frissons Partner Program.
We only pay Commission via bank transfer. To qualify for payment, you will need to provide correct bank details.
General Provisions
This agreement is governed by applicable U.S. laws, with any disputes subject to the jurisdiction of relevant U.S. courts. It is understood that this document constitutes the entire agreement, superseding any prior communications.
By joining the Etoiles Frissons Partner Program, you accept these terms and acknowledge your responsibility in upholding them, ensuring a prosperous and ethical partnership.
